Revisions to Oil Pipeline Regulations Pursuant to the Energy Policy Act of 1992, Docket No. RM93-11-000 “Notice of Annual Change in the Producer Price Index for Finished Goods” (May 15, 2012); 139 FERC ¶61,123 (2012).

FERC’s regulations include a methodology for oil pipelines to change their rates through use of an index system that establishes ceiling levels for such rates. FERC bases the index system on the annual change in the Producer Price Index for Finished Goods (PPI-FG), plus 2.65 percent (PPI-FG+2.65). In 2010, FERC determined that PPI-FG+2.65 is the appropriate oil pricing index factor for pipelines to use for the five-year period commencing July 1, 2011. The regulations provide that FERC will publish annually, an index figure reflecting the final change in the PPI-FG, after the Bureau of Labor Statistics publishes the final PPI-FG in May of each calendar year. The annual average PPI-FG index figures were 179.8 for 2010 and 190.5 for 2011. “Thus, the percent change (expressed as a decimal) in the annual average PPI-FG from 2010 to 2011, plus 2.65 percent, is positive 0.086011. Oil pipelines must multiply their July 1, 2011, through June 30, 2012, index ceiling levels by positive 1.086011 to compute their index ceiling levels for July 1, 2012, through June 30, 2013.”

FERC “affirms its basic determinations in Order No. 1000, amending the transmission planning and cost allocation requirements established in Order No. 890 to ensure that Commission-jurisdictional services are provided at just and reasonable rates and on a basis that is just and reasonable and not unduly discriminatory or preferential.”

FERC issued a policy statement to explain how it will provide advice to the Environmental Protection Agency (EPA) for it to rule on requests for Administrative Orders (AO) to operate in noncompliance with EPA’s Mercury and Air Toxics Standards (MATS). “The Commission believes that it is important to provide as much guidance to industry as possible as to how the Commission intends to provide advice to the EPA on any OA request.” FERC said each AO request should be filed with the Commission, which will treat it as an informational filing. FERC’s review will examine whether, based on the circumstances presented, there might be a violation of a Commission-approved Reliability Standard. “In addition, the Commission’s comments to the EPA could also identify issues, pursuant to our other areas of authority, raised by the AO request for the EPA to consider as critical to reliability. Further, an [electric generating unit’s] continued operation may have reliability impacts beyond those implicated by the Commission’s jurisdiction. The EPA should look to NERC and state commissions, among the other entities it has enumerated, for guidance in those areas.”
